Can you notarize a document if the signer(s) are not present?

No - traditional in-perosn notarizations require physical presence. The State of Florida does allow Remote Online Notarization (RON) as long as the notary has been authorized by the State to perform them.

What forms of identification are acceptable?

Signers must present a current, government issued photo ID, such as a US passport, state-issued driver's license, or military ID. Expired ID's are generally not accepted.

Can a notary prepare or choose the type of document I need?

No. Notaries are prohibited from preparing legal documents or offering legal advice unless they are also licensed attorneys.

Can a notary refuse to notarize a document?

Yes. A notary must refuse service if the signer cannot produce valid ID, appears confused or coerced, or ig the document is incomplete.

What notarial acts can a Florida notary perform?

  • Taking Acknowledgments: Verifying that a signer voluntarily signes a document for its stated purpose.
  • Administering Oaths/Jurats: Swearing or affirming that the statements in a document are true.
  • Attesting Photocopies: Certifying that a photocopy is a true and accurate copy of an original document (vital records are strictly prohibited).
  • Solomnizing Marriages: Legally performing marriage ceremonies.
  • Verifying Vehicle Identification Numbers (VINs): Inspecting and verifying VINs on official motor vehicle forms.
  • Certifying Safe Deposit Boxes: Verifying the contents of a box for nonpayment of rental fees.
